Permitted Development Rights for Schools
A Guide to Easier, Faster Classroom Expansion
Did you know that one in every four schools in the UK is at or over capacity? This, along with evolving curriculum demands and space shortages, is causing many to turn to modular buildings as a quick, cost-effective solution.
But before you worry about planning permission delays and red tape, there’s good news: most schools can extend or build new classrooms in weeks and without needing full planning permission. This is thanks to the April 2021 changes made to promote infrastructure growth.
By using permitted development rights, schools can access faster project timelines, lower costs, and far less hassle. Avoiding the planning process can shave off months, often making it possible to complete builds during the summer break instead of waiting another year.

What Are Permitted Development Rights?
Permitted development rights (PDRs) are a set of planning rules that allow certain building works to go ahead without the need for a full planning application. For schools, these rights are a real game-changer, especially since the government updated the legislation in April 2021 to support infrastructure growth and ease pressure on the education system.
In short, you may be able to build or extend your school building faster, cheaper, and with far less bureaucracy than you expected.
What Schools Can Build Without Planning Permission
The updated rules are clear and surprisingly generous. Here’s what schools can now do under UK permitted development:
Build Up to 25% of the Existing Footprint – or 250m²
Whichever is greater. The “existing footprint” is based on the school as it stood on 21st April 2021. So, if your school was already sizeable by then, you have even more flexibility.
Build Two Storeys
The rules are now based on building footprint, not total floorspace, so a two-storey modular block still counts the same as a single-storey one in terms of area used.
Build Away From Playing Fields
Playing fields are protected and can’t be developed under PDRs. However, in most cases, schools want to build close to existing buildings anyway to maintain safe and efficient access between classrooms, so this doesn’t present a big problem.
Meet the Height Limits
- Up to 5 metres high within 10 metres of the school boundary (curtilage).
- Up to 6 metres high elsewhere, but not higher than the original building being extended or altered.
Why the 2021 Permitted Development Changes Matter
Previously, schools were limited to 100m² of additional gross floorspace for any changes or outbuildings constructed since July 1948. Many schools had already hit or exceeded that limit, which meant planning permission was required for even modest extensions.
The 2021 rule change lifted that burden, allowing far more freedom and reducing both the time and cost associated with expanding school facilities.

Are There Still Rules to Follow?

Yes, and this is where a lot of schools leave time on the table. Permitted development rights remove the planning delay, but they do nothing about the procurement delay. If you then spend three months running a tender, you’ve handed back the time PDR just saved you.
